Ep 512: The LatAm Lowdown: Bettor's Rights in Brazil, Betano in Buenos Aires, Collusion in Chile and a Purge in Peru

A busy week in Latin America gives our team a chance to run you through a bunch of fascinating stories from Brazil to Chile to Peru to Argentina. This is the LatAm lowdown on iGaming Daily, sponsored by Optimove.

Firstly in São Paulo, a court ruling against Betano forced the operator to lift a betting limit on a customer's account.  The judge found no evidence of problem gambling, fraud, match-fixing, or terms breaches and ordered Betano to pay court costs and legal fees. While 400 or so miles north, in Minas Gerais, the court ordered B365 to reactivate a user's account that was blocked apparently due to the better's profitable performance The court found the platform's contract clause allowing unilateral account termination to be abusive, violating principles like good faith and contractual balance under Brazil's consumer protection code.

The precedent is set, arbitrary rulings can be challenged through the courts in Brazil, and moves that operators have made all over the world, might not wash in the new regulated market. Is this a good thing? Or could this prove problematic? What impact does this have on problem gambling? And how will operators deal with this uncertainty?

Elsewhere in LatAm, our Spanish speakers tag in to discuss an ongoing collusion investigation in Chile, involving casino operators Marina del Sol, Enjoy, and Dreams. An appeal to revoke the existing licenses of the three operators by Corporación Mayor, was rejected by the justice system but the push for a ban on future bids continues amidst ongoing bidding process.

In Peru, Illegal gambling operations are a significant concern since the industry was regulated in February last year, Authorities have intensified oversight, resulting in the closure of illegal establishments and the removal of 50% of illegal websites from the Peruvian market, reducing the supply of illegal gambling on digital platforms and applications by 40%. And finally in Argentina, Betano are back, but this time in a much more positive story. Kaizen Gaming's Betano brand has reached a major sponsorship agreement with iconic Argentine football club River Plate, The deal is reportedly for three seasons at approximately $6 million per year. This partnership is expected to significantly increase Betano's exposure, especially through River Plate's participation in the Copa Libertadores and the upcoming FIFA Club World Cup.
